Doccom Locum

If you are a medical professional and have access to DocCom Locum for the purpose of seeking locum positions, you represent and warrant that you: (a) are properly trained, qualified and experienced; (b) have an appropriate level of experience for any particular roles that you apply for; (c) hold a current registration to practise as a doctor, nurse or other medical professional (as applicable) in the United Kingdom; and (d) are otherwise allowed to practise as a doctor, nurse or other medical professional (as applicable) in the United Kingdom and have not been suspended or prohibited from doing so. You will indemnify us for any loss or damage arising from or in connection with any breach of this term by you.

Intellectual property rights

Except as expressly set out below in relation to content submitted by you (see 'Uploading Material to these Websites'), all copyright, trade marks, database right and other intellectual property rights in these websites and in the content and material published on it (including text, graphics, software, photographs and other images, videos, sound and logos) are owned by us or our licensors (which includes other users). Except as expressly set out in these Terms of Use, nothing in these Terms of Use gives you any rights in respect of any intellectual property rights owned by us or our licensors and you acknowledge that you do not acquire any ownership rights by downloading content from these websites.

You may print off one copy, and may download extracts, of any page(s) from these websites for your personal reference, provided that: (a) such copying is not substantial or systematic; (b) any copyright, trade marks and other intellectual property right notices contained in the original content are reproduced; (c) our status (and that of any identified contributors) as the authors of content on these websites is acknowledged; and (d) you must not modify the paper or digital copies of any materials you have printed off or downloaded in any way.

We provide DocCom Locum as a portal service, and are not responsible for screening or selecting any medical staff that are put forward for vacancies within DocCom Locum ("Locums"). We do not represent that any Locums: (a) are properly trained, qualified and experienced; (b) that they have an appropriate level of experience for any particular role; (c) that they hold a current registration to practise as a doctor, nurse or other medical professional (as applicable) in the United Kingdom; or (d) are otherwise allowed to practise as a doctor, nurse or other medical professional (as applicable) and have not been suspended or prohibited from doing so. We exclude all liability for any loss or damage arising from or in connection with any recruitment decisions made using DocCom Locum, including any loss or damage arising from or connected to any third party claims resulting from any acts or omissions of Locums appointed using DocCom Locum.

Except as expressly provided by these Terms of Use, all representations, warranties, conditions, terms or other undertakings of any kind, whether express or implied, statutory or otherwise, are excluded. In particular, no condition, warranty, representation or other term is given or entered into to the effect that these websites or the Services will be of satisfactory (or any other) quality, that they will be fit for any particular purpose, that use of these websites or Services will be uninterrupted or error-free, that they will perform to or operate in accordance with any particular standard, that use of these websites or Services will comply with applicable laws, or that the content on these websites is accurate, complete and complies with applicable laws.

We will not be liable for any: (a) loss of income or revenue; (b) loss of business; (c) loss of profits; (d) loss of contracts; (e) loss of anticipated savings; (f) loss of data or software; (g) loss of goodwill or reputation; (h) wasted management or office time; or (i) indirect, consequential or special loss; arising from or in connection with any use of or inability to use these websites or Services, any websites linked from these websites and any content posted on or transmitted via these websites or Services, however such loss arises (whether from breach of contract, tort (including negligence) or otherwise) and whether or not such loss was foreseeable.

Information about you and your visits to these websites

Where you supply personal information to us as part of our registration process or as part of your use of these websites or Services, we will collect, store and use that personal information in accordance with our Privacy Policy, which forms part of these Terms of Use. By using these websites and Services, you consent to such processing, and you warrant that all data provided by you is accurate and up-to-date.

Viruses, hacking and other offences

You must not misuse these websites or Services by knowingly introducing viruses, Trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to these websites or Services, the servers on which these websites are stored or any server, computer or database connected to these websites. You must not attack these websites or any Services via a denial-of-service attack or a distributed denial-of service attack.
